Welcome to Padhai. These Terms of Service ("Terms") constitute a legally
binding agreement between you and RSustain (Resilient Sustainance Private Limited) ("we", "us", "our"),
governing your access to and use of the Padhai platform ("Platform"),
available at padhai.rsustain.com.
By creating an account or using the Platform, you agree to be bound by these Terms.
If you do not agree, you must not use the Platform.
1. Eligibility
Padhai is designed for students in classes 8–12 in the Indian education system.

Minors (under 18): You may use Padhai only with the
verifiable consent of your parent or lawful guardian, as required by the
Digital Personal Data Protection Act, 2023 (DPDP Act). We will collect
parental consent before processing your personal data.

Parents/Guardians: By granting consent, you confirm that
you are the child's parent or lawful guardian and that you have reviewed
these Terms and our Privacy Policy.

Teachers: Teacher accounts may be created by educational
institutions. You represent that you are authorised by your institution to
create and use such an account.
2. Account Creation and Security
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately at legal@padhai.rsustain.com if you suspect unauthorised access to your account.
- One person may maintain only one active student account.
- We reserve the right to suspend or terminate accounts that contain false information.
3. Acceptable Use Policy
When using Padhai, you agree NOT to:
- Share your account credentials with others or allow others to access your account
- Attempt to reverse-engineer, decompile, or extract source code from the Platform
- Use automated scripts, bots, or scrapers to access the Platform or its content
- Attempt to circumvent rate limits, subscription restrictions, or access controls
- Reproduce, distribute, or publicly display any Platform content without written permission
- Submit false, misleading, or harmful content through any input mechanism
- Use the Platform to harass, bully, or harm other users
- Attempt to access other users' accounts, data, or progress information
- Interfere with or disrupt the Platform's infrastructure or security systems
Violation of this policy may result in immediate account suspension or termination
without refund.
4. Intellectual Property
4.1 Our Content
All content on Padhai — including but not limited to questions, solutions,
explanations, worked examples, theory text, adaptive algorithms, user interface
designs, graphics, and software code — is the intellectual property of RSustain (Resilient Sustainance Private Limited)
or its licensors and is protected under the Copyright Act, 1957 and other applicable
Indian intellectual property laws.
4.2 Your Content
You retain ownership of any original content you submit (such as feedback or
suggestions). By submitting content, you grant us a non-exclusive, worldwide,
royalty-free licence to use, reproduce, and adapt such content for the purpose
of improving the Platform.
4.3 Restrictions
You may not copy, reproduce, screenshot, or distribute questions, solutions, or
any other Platform content. Sharing exam-preparation content from Padhai on
social media, messaging apps, or other platforms is expressly prohibited.
5. Subscription Plans and Payment Terms
5.1 Free Tier (Foundation)
The Foundation tier provides limited access to the Platform at no cost, including
a daily question limit. No payment is required.
5.2 Paid Tiers

All prices are in Indian Rupees (INR) and inclusive of applicable taxes.
5.3 Payment Processing
Payments are processed securely through Razorpay, a PCI-DSS
compliant payment gateway. We do not store your card details, UPI IDs, or
banking credentials on our servers.
5.4 Auto-Renewal
Subscriptions auto-renew at the end of each billing period
(monthly or annual) unless cancelled at least 24 hours before the renewal date.
You can cancel auto-renewal at any time from your account settings or by
emailing legal@padhai.rsustain.com.
6. Refund Policy
6.1 14-Day Money-Back Guarantee
If you are not satisfied with your paid subscription, you may request a
full refund within 14 days of your initial purchase. This
guarantee applies to first-time subscriptions only.
6.2 How to Request a Refund
- Email legal@padhai.rsustain.com with the subject line "Refund Request"
- Include your registered email address and transaction/order ID
- Refunds will be processed within 7–10 business days to the original payment method
6.3 Non-Refundable Situations
- Requests made after the 14-day period
- Renewal charges (cancel before renewal to avoid charges)
- Accounts terminated for violation of these Terms
7. Limitation of Liability
To the maximum extent permitted by applicable Indian law:

The Platform is provided on an "as is" and "as available"
basis without warranties of any kind, whether express or implied.

We do not guarantee that use of the Platform will result in any particular
academic outcome, exam score, or admission result.

Our total liability for any claim arising from your use of the Platform shall
not exceed the amount you have paid us in the 12 months preceding the claim.

We shall not be liable for any indirect, incidental, special, consequential,
or punitive damages, including loss of data, academic opportunities, or goodwill.

We are not liable for interruptions, delays, or errors caused by factors
beyond our reasonable control, including internet connectivity issues,
device failures, or force majeure events.
8. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of
India.

Any dispute arising out of or in connection with these Terms shall first be
attempted to be resolved through good-faith negotiation between the parties.

If the dispute is not resolved within 30 days, it shall be referred to
arbitration in accordance with the Arbitration and Conciliation Act, 1996,
as amended. The seat of arbitration shall be New Delhi, India.

The courts of New Delhi, India shall have exclusive jurisdiction over any
matters not subject to arbitration.
9. Termination
9.1 By You
You may delete your account at any time by contacting us at
legal@padhai.rsustain.com. Upon account
deletion:
- Your personal data will be deleted within 90 days (except data retained under legal obligation)
- Any active paid subscription will not be refunded for the remaining period unless within the 14-day guarantee window
- Your progress, scores, and learning data will be permanently erased
9.2 By Us
We may suspend or terminate your account immediately, without prior notice, if:
- You violate these Terms or the Acceptable Use Policy
- You provide false or misleading registration information
- We are required to do so by law or a court order
- Your account has been inactive for more than 24 months
10. Consumer Protection Compliance
In compliance with the Consumer Protection (E-Commerce) Rules, 2020,
we disclose the following:
10.1 Cancellation Rights
As per the E-Commerce Rules, you have the right to cancel a paid subscription
within 14 days of purchase and receive a full refund. See Section 6 above for
the detailed refund policy.
10.2 Service Description Accuracy
We endeavour to accurately describe all features, content, and limitations of
each subscription tier. If you believe a feature was materially misrepresented,
please contact us for resolution.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material
changes, we will:
- Notify you by email at least 15 days before the new terms take effect
- Post a prominent notice on the Platform
- Update the "Last updated" date at the top of this page
Your continued use of the Platform after the effective date of any modifications
constitutes acceptance of the updated Terms. If you do not agree to the modified
Terms, you must stop using the Platform and may request account deletion.
12. Miscellaneous

Severability: If any provision of these Terms is found to be
unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any provision does not constitute
a waiver of our right to enforce it in the future.

Entire Agreement: These Terms, together with the Privacy Policy,
constitute the entire agreement between you and us regarding the Platform.

Assignment: We may assign our rights and obligations under these
Terms to an affiliate or successor entity. You may not assign your rights without
our prior written consent.
